Operator: Polytope KK (a Japanese kabushiki kaisha) (“DASHIBANK”, “we”, “us”)
By creating an account or using DASHIBANK (the “Service”), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
DASHIBANK is a concierge service that arranges restaurant reservations on your behalf. We place reservation requests with restaurants for you and report the outcome.
We are not a restaurant and do not own, operate, or control any restaurant.
A reservation is made only if the restaurant accepts it. We do not guarantee that any particular reservation can be secured, nor the conduct, availability, quality, pricing, or honoring of any reservation by a restaurant.
We contact restaurants using an automated assistant that identifies itself as calling on behalf of a real customer.
2. Eligibility and accounts
You must be an adult capable of entering a binding contract. You are responsible for the accuracy of your account information and for maintaining the security of your credentials. You are responsible for activity under your account.
3. Your responsibilities
You agree to:
Provide accurate reservation details and contact information.
Request bookings only that you genuinely intend to honor, and that you are authorized to request (including for any additional guests in your party).
Honor your reservations. Repeated no-shows or abuse of restaurants undermines the Service and the trust it depends on, and may result in suspension or termination of your account (see §6).
Use the Service lawfully and not for harassment, spam, fraud, or any purpose that burdens or harms restaurants, other users, or us.
4. Fees and billing
The Service is provided for a fee. Pricing is presented in the Service and may be outcome-based (for example, charges may differ for a confirmed versus a declined reservation). You authorize us and our payment processor to charge the applicable fees and to manage account funding as described at sign-up. Fees are non-refundable except as required by law or expressly stated. We may change pricing prospectively with notice.
Card holds at restaurants. Some restaurants and ryokan require a credit card to hold a seat or fixed menu. If you opt in and the restaurant or ryokan requires it on that call, our agent may read your credit card (not debit) to the restaurant when they ask. The hold is between you and the restaurant — their no-show and cancellation rules apply to you directly; we do not guarantee the hold or manage restaurant charges.
Stored call records. Card numbers are spoken to the restaurant on the live call only. In the transcripts, recordings, and archives we retain for operations and quality, full card numbers are automatically removed after the call by our telephony provider’s privacy controls (redacted placeholders; scrubbed audio). We do not store full card numbers in our application database or customer-facing call history.
5. Cancellations and no-shows
You may cancel a reservation by notifying us; we will use reasonable efforts to relay a cancellation to the restaurant. Cancel at least 48 hours before your reservation when you can. Restaurants set their own cancellation and no-show rules; late cancellations and no-shows often mean losing 25–100% of the meal cost to the restaurant, in addition to any consequences the restaurant imposes directly. We may delete or suspend accounts associated with verified no-shows or abusive conduct, consistent with the trust-based nature of the Service.
6. Suspension and termination
We may suspend or terminate your access at any time for breach of these Terms, suspected fraud or abuse, non-payment, or as required by law. You may stop using the Service and close your account at any time. Sections that by their nature should survive termination (including §§4, 7–12) will survive.
7. Our technology and intellectual property
The Service, including its software, content, design, trademarks, and the proprietary systems, models, processes, and methods used to operate it, is owned by us or our licensors and is protected by law. These methods are confidential and proprietary.You may not copy, modify, distribute, reverse engineer, decompile, scrape, probe, or attempt to derive, extract, or reconstruct the Service’s underlying technology, data, or methods, or use the Service to build a competing product. No rights are granted except the limited right to use the Service under these Terms.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT A RESERVATION WILL BE OBTAINED, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT RESTAURANT INFORMATION IS ACCURATE OR CURRENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR ANY RESTAURANT’S ACTS OR OMISSIONS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF ¥10,000 OR THE FEES YOU PAID US IN THE 6 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify and hold us harmless from claims and costs arising from your misuse of the Service, your breach of these Terms, or your reservations and interactions with restaurants.
11. Third parties
Restaurants and other third parties are independent of us. We are not responsible for their acts, omissions, policies, or any agreement between you and them.
Maps and imagery. Maps and street-level imagery shown in the Service are provided by Google — © Google and its contributors — and are used under the Google Maps/Google Earth Additional Terms of Service and subject to the Google Privacy Policy. Such imagery may be cropped, scaled, or colour-adjusted for presentation within the Service; all rights in it remain with Google and its contributors.
Base map. The base map is built from OpenStreetMap data — © OpenStreetMap contributors, available under the Open Database License (ODbL) — and rendered with Protomaps.
12. Governing law, consumer rights, and disputes
These Terms are governed by the laws of Japan, without regard to conflict-of-laws rules, and the Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute (Polytope KK’s registered office being in Setagaya-ku, Tokyo).
Your mandatory local consumer rights are preserved. A choice of governing law cannot be two jurisdictions at once, so we select one primary law above. Nothing in these Terms, however, removes the protection of mandatory consumer-protection laws of your country or state of residence that cannot be waived by agreement — including, where applicable, the laws of Japan, the United States (and your U.S. state), and the EEA or United Kingdom where you reside there. Where such a mandatory law conflicts with these Terms, that law prevails to the extent of the conflict, and the rest of these Terms continues to apply.
13. Changes
We may update these Terms. Material changes will be posted with a new effective date and, where required, notified to you. Continued use after changes take effect constitutes acceptance.
